Former Fresno City College instructor Brian Calhoun’s trial for alleged battery against a student has been postponed from Wednesday, Sept. 25 to Monday, Sept. 30.
Fresno County Superior Court Judge Dennis Peterson granted Calhoun a delay for investigation matters in his trial for battery against FCC student Kevynn Gomez.
After the judge granted the move, Attorney Roger Nuttall, representing Calhoun, spoke to reporters in the lobby of the Fresno County Superior Courthouse.
Calhoun was in attendance but declined to comment to reporters. He let his attorney speak for him.
“We didn’t want to waste time on this trial when the process is finalizing motions … which are extensive,” Nuttall said
Nuttall also said that investigation matters are “coming to a head.”
Calhoun is accused of battery against Gomez on March 22, 2013 in the Old Administration Building of FCC. Calhoun was placed on leave and then fired from FCC because of the incident.
In his statement to reporters, Nuttall said his client was the victim in the altercation with the student.
“I’m just [going to] make it real clear and short,” Nuttall said. “Brian Calhoun isn’t guilty in this case, and as far as I’m concerned, he’s the one who was victimized, period.”
The misdemeanor trial is set to begin on Sept. 30 at 8:30 a.m.
